Social Security Benefits


The federal government, through the Social Security Administration, provides a benefit to those people who it determines to be disabled from any gainful employment.

There are two types of disability benefits. The social security disability benefit is available to those persons who have a significant work history and have made payments to the social security during the period of time they were gainfully employed. Those payments are usually an automatic deduction by the employer, but it can be an issue for self employed persons. If you are found to be eligible, you would receive a monthly benefit that reflects how much you have paid into the fund.

The other type of benefit is social security insurance. This is for those persons who have no significant work history, but are nevertheless disabled from any substantial gainful employment. Children may also be eligible for this type of benefit.

It is not uncommon for an individual to be denied benefits during their initial application. However, that denial can be appealed and a hearing requested before an administrative law judge. This hearing is an opportunity to not only tell a judge how your disabilities effect your life, but to argue how these disabilities meet the established legal standards.
