Discrimination occurs in the workplace for a variety of reasons, including:

  • race
  • disability
  • gender
  • pregnancy status

There are clear laws that protect individuals from these types of discrimination.

There are other forms of discrimination that can be detrimental to an individual and their overall work experience, including discrimination based on sexual orientation. What are the laws in Pennsylvania regarding discrimination based on sexual orientation?

What Is Discrimination Based on Sexual Orientation?

Discrimination takes many forms, including firing a person, harassing them at work, or even leaving them out of meetings or opportunities for advancement.

An example of discrimination based on sexual orientation is when an employer fires an employee after learning that he or she identifies as homosexual. The reverse also applies, although this type of discrimination is less common.

Federal Laws Regarding Discrimination Based on Sexual Orientation

Unfortunately, attempts to pass federal laws that prohibit discrimination in the workplace on the basis of sexual orientation have been unsuccessful. While federal employees are protected from this type of discrimination, there are no laws to protect employees in the private sector.

It is up to states and localities to pass their own laws regarding discrimination based on gender identity and sexual orientation.

Local Laws May Offer Protection For Individuals Who Have Been Discriminated Against

Pennsylvania was one of the first states to pass local laws protecting individuals employed in the private sector against workplace discrimination based on sexual orientation.

While not all localities have passed legislation that offers individuals protection against this type of discrimination, many have, including:

  • Abington Township
  • Allegheny County
  • Allentown City
  • Bethlehem City
  • Downington Borough
  • Easton City
  • Haverford Township
  • Lancaster City
  • Philadelphia City
  • Pittsburgh City
  • Scranton City
  • Westchester Borough
  • York City
